hire terms and conditions

BOHOTANICAL respectfully reserves the right to amend these terms and conditions at any time and you should therefore check them each time you hire items from us. The terms and conditions applying to your hire will be those in place on the date that you make your booking, and will be stated on your contract with us.

YOUR QUOTATION

Quotations are valid for 14 days from date of issue; we reserve the right to revise the quotation after this period.

Unfortunately, due to the high demand for bookings, it is not possible to reserve you day prior to the payment of the deposit.

Payment of your deposit is deemed an instruction of your booking. 

 

OUR HIRE ITEMS

All items for hire remain the property of BOHOTANICAL at all times, and throughout the hire period. You will be solely responsible for the safe-keeping of all hire items from point of pick-up/delivery, through to their collection/return.

All efforts have been made to represent our items accurately in our photographs, however sometimes there may be slight discrepancies with colour due to different monitors showing different saturation and photographs being taken in different lighting and we cannot be held accountable for this. Every care is taken to provide the items as you expect them.

If an item you have booked is damaged or lost prior to your hire taking place you will be informed and every effort will be made to replace the item like for like. If this is not possible or if this is unsatisfactory, you will be entitled to a refund for that item only. No further compensation will be due.

All hire items are intended for indoor use only; any items used outside are done so entirely at the hirer’s risk, and may result in damage charges becoming payable.

The standard hire period is a maximum of 72 hours; extended hire periods might be available upon request.

 

PICK UP/DELIVERY/INSTALLATION/DROP OFF/COLLECTION

Orders of under £100 (item hire only), must be collected from, and returned to, us - only orders over £100 are eligible for delivery and installation.

Pick up from our warehouse at Unit 3, Bellingham Way, Aylesford ME20 7HP, is free of charge.

Our standard pick up times are between the hours of 8am and 6pm.

You are responsible for ensuring that you have sufficient space in your collection vehicle, and that there is adequate protection/security for them. We will pack most items in bubblewrap and plastic boxes; please return in the manner in which they were provided. If we feel the risk of damage to our items is too high to release them, we reserve the right to refuse the release of said items, with no recompense due to you.

Delivery/collection is charged at £0.45 per mile, round-trip.

It is the hirer's responsibility to ensure that access to the venue is available, allowing sufficient time for the installation required.

Signing of the pick up/delivery/drop off/collection document constitutes your agreement that the items are as requested, and are in good condition. You may not request a reduction/refund on payment based on failure to supply, quality, or condition of our hire items if this statement has been signed. You may use a proxy for this, such as a member of venue staff.

Installation is charged at 50% of the hire value.

Item collection by ourselves should be from a single address at a single time. 

Items for collection must not be left in an unsecured or unattended location.

Safe and legal parking is required for all deliveries and collections. We reserved the right to cancel a booking if this need is not met.

Drop offs are to our warehouse at Unit 3, Bellingham Way, Aylesford ME20 7HP, and are to be made at an agreed time. You must not leave the items unattended outside our unit.

FEES & PAYMENTS

There are no hidden charges whatsoever. We are not a VAT registered business, so quotations will not list this as a separate entity.

Your booking fee (50% of the total hire/delivery/installation/collection fee) must be sent to the following bank account in order to confirm your booking:

The full balance is required one calendar month before the wedding date.

In addition, a refundable security deposit, equal to 50% of the total hire/delivery/installation/collection fee, is payable. Subject to there being no breakages/losses, this will be returned to you within 14 days post-wedding day; any items that have been damaged or broken will be charged for at full replacement cost, and will be subtracted from the security deposit. Damages or losses amounting to a value greater than the security deposit will be invoiced for separately. Payment terms are 14 days from date of issue. 

Failure to pay all monies due by the start date of the booking will be considered as a breach of contract, and we will no longer be responsible for fulfilling our obligations to the booking. 

Failure to return items at the specified time, will result in a charge of 25% of the total hire fee for each additional day (or part thereof), over the 72 hour allowance. If the delayed return adversely affects another booking, you will be liable for the full value of that booking. This will be subtracted from your security deposit, and any excess will be invoiced for separately.

We reserved the right to pursue financial compensation through legal means for all breaches of contract, including the use of a debt collection agency, to whom you will become liable.

 

CANCELLATION

In the event that you are forced to change the date and/or location of the wedding, every effort will be made by BOHOTANICAL to accommodate the new date/location, however this cannot be guaranteed, and the deposit shall remain non-refundable (as it would also be if the wedding was to be cancelled outright). BOHOTANICAL is consequently released from all contract obligations and shall in no way be held responsible or liable for non-performance. In the event of a new date being set, a new contract will need to be signed. Please be aware that additional costs (including, but not limited to, travel/accommodation/assistants) may become payable. With regret, cancellations made within 3 calendar months of the wedding date will need to be paid in full, as it is unlikely that BOHOTANICAL would be able to recoup the lost revenue due to turning away bookings in favour of your own.

Cancellations will not incur any further charges if made more than 3 calendar months+1 day prior to the balance due date, and any monies paid in advance (excluding the 50% booking fee), shall be refunded (please allow 28 days for this). With regret, should the order be cancelled on or after the date which is 3 calendar months before the balance due date, the following sliding scale will be enforced:

Cancelled on or after 3 calendar months prior to the balance due date: 50% of the agreed or anticipated Grand Total 

Cancelled on or after 2 calendar months prior to the balance due date: 75% of the agreed or anticipated Grand Total 

Cancelled on or after 1 calendar month prior to the balance due date: 100% of the agreed or anticipated Grand Total

In the event of accident, serious illness or hospitalisation on our part, and if we are unable to find cover for the booking, unearned fees will be refunded within 10 days.

Postponement will be considered on a case-by-case basis - I will always endeavour to accommodate your new date, but in any event, the booking fee will remain non-refundable, and if not, the sliding scale may come into effect.

 

EXCLUSIONS

While every effort is always made to ensure that both myself and your styling items arrive to you on time and in perfect condition, special circumstances mean that we cannot reasonably be held responsible for:

Delay/non-delivery of your styling items due to unforeseen circumstances, such as (but not limited to) accident (regardless of fault), inclement weather conditions, industrial action. In any event,  I will always attempt to source alternatives, as close to the original specification as possible, but please be aware that additional costs may be incurred that you will be liable for;

Delay/non-delivery on the day due to non-fault accidents/breakdowns (an alternative method of transportation will be sought but cannot be guaranteed);

Delay due to unexpected and unavoidable traffic issues, such as those due to accidents or severe weather conditions;

All of our items are well maintained, and will be released to you in full working order. Vintage items may not meet current EC regulations. 

We are not responsible for any injury or damage to persons, animals, or property arising from the use of any hire items. We shall not be liable for any direct, indirect or resulting loss, damage or additional costs that may arise as a result of the use of our hire items.

 

We always recommend that every couple takes out wedding insurance to cover every eventuality.
